Tammerello v. Ameriquest Mortgage Co., No. 05-0466, 2006 WL 2860936 (N.D. Ill. Sept. 29, 2006)

The plaintiff in this case alleged fraud in connection with the signing of his mortgage loan.  When VBLH&C argued that the statute of limitations on the plaintiff’s claim had run, the plaintiff tried to switch the factual basis for his claims.  As VBLH&C successfully argued, however, allowing the plaintiff to switch the factual basis for his claim after discovery was completed would be improper.  The district court agreed and granted summary judgment for the defendants.
