Michael Hayes is a seasoned trial lawyer with extensive experience litigating a broad range of complex civil and criminal matters in state and federal trial and appellate courts and before regulatory agencies. Mr. Hayes is recognized for his experience and results in class action litigation. He has served as Chair of the Class Litigation Committee of the Chicago Bar Association, and is a frequent speaker on various class action topics.

Mr. Hayes represents mortgage lenders, mortgage servicers, banks, finance companies, and other companies and individuals in a broad range of consumer litigation matters, including suits involving claims under various federal statutes (TCPA, TILA, CLA, RESPA, FHA, ECOA, FCRA, and FDCPA) and state consumer protection statutes. His practice in this area is national in scope; he regularly appears for his clients in cases pending in state and federal courts throughout the country. He has acted as national litigation counsel to a major mortgage lender, and regularly litigates employment related claims for his financial services and other business clients.

In addition to consumer related litigation, Mr. Hayes also has extensive experience in environmental law issues, representing clients in both litigation and non-litigation matters. He has defended industrial and real estate clients in government enforcement proceedings, and has prosecuted and defended private party environmental claims arising from the sale of industrial properties. Mr. Hayes is particularly proud of his efforts for families impacted by industrial pollution, where as class counsel he has successfully represented classes of residents in environmental property damage class litigation (involving claims under RCRA, CERCLA and various state environmental laws), achieving badly needed remediation of contaminated residential properties and drinking supplies, as well as monetary recoveries for his clients in excess of $65 million. Mr. Hayes is a frequent speaker on class certification and other Rule 23 issues in environmental and other types of cases.

In the area of class actions and mass torts, Mr. Hayes has been named as an Illinois Super Lawyer, a peer-based recognition for outstanding attorneys who have attained both a high degree of professional achievement and the respect of their peers.

Representative Engagements

  • Acted as national litigation counsel to major mortgage lender concerning individual and class action suits alleging violations of various federal (TILA, CLA, RESPA, FHA, ECOA, FCRA, and FDCPA) and state consumer protection statutes.
  • Defended class action suits against individuals and businesses brought under the TCPA related to sending of “junk fax” and “junk text” advertisements.
  • Defended national food manufacturer in state and federal class litigation concerning product labeling and internet, print and signage advertising.
  • Acted as class counsel to families impacted by contamination of their homes and drinking water supplies, achieving remediation of dangerous environmental conditions and monetary property damage recoveries in excess of $65 million.
  • Represented businesses/policyholders in insurance coverage tenders, disputes and litigation, achieving multi-million dollar financial recoveries and insurer agreements to defend our clients in thousands of existing and future asbestos and other lawsuits.
  • Successfully represented clients in defense of individual and class action employment suits alleging harassment, wrongful discharge and violation of federal and state wage and hour laws.


Professional and Community Involvement

  • Active member of Chicago Bar Association’s Class Litigation Committee: Chair (2009-10); Vice Chair (2008-9); Seminar Coordinator (2007-8).
